Expunction vs. Nondisclosure: What’s the Difference?
You may have heard both terms. You may have heard people use them interchangeably. Technically, they’re two different options under Texas law.
- Expunction: Expunction takes a giant eraser to your entire criminal record. It removes everything across all files, so that nobody can see you were once in trouble. Expunction is an option for you if you were found not guilty, if you were arrested but your case was never filed, or if you meet certain other criteria. We often consider expunction as part of our complete case strategy for our clients. First, we work to have the person found not guilty. Then, we work to have the record expunged.
- Nondisclosure: Nondisclosure means that the criminal charge will not be visible when employers, landlords or school officials look at your criminal record. But, law enforcement officials will still be able to see it. Many people who are not eligible for expunction are still eligible for nondisclosure.
